The first thing to expect when pulled over by an officer is a variety of field sobriety tests:

  • Horizontal Gaze Nystagmus (HGN) or eye test
  • Walk and Turn / Heel to Toe
  • One Leg Stand
  • Finger to Nose
  • Alphabet Test
  • Preliminary Breath Test (PBT)

If arrested, you may be asked to submit to a breath test, blood or urine test at the police station or local hospital. These tests are performed with either a breath machine called an Intoximeter, or by means of a hypodermic needle.

  • If it is your second offense or greater for DUI/DWI/OWI (operating while intoxicated), you may be forced to submit to a blood test
  • If your test result is greater than .08, or .02 in a fourth or greater offense, you will also be issued a citation for operating with a prohibited alcohol concentration (PAC)
  • If you refuse any tests, you will receive a notice of intent to revoke, which notifies you that your driver’s license may be revoked if you fail to request a hearing within 10 days.

Following chemical testing, you will either be released to a responsible party or taken to jail.

  • If you have received a citation for driving under the influence, and submitted to a chemical test, the result of which indicated a prohibited alcohol concentration of .08 or greater, or .02 in a fourth or greater offense, you will also receive a Notice of Intent to Suspend Operating Privileges. This is separate from the DUI charge. As the Notice of Intent informs you, if you do not request a review hearing with the Department of Transportation within 10 days, (13 days if the notice is mailed to you) your drivers license will automatically be suspended for six (6) months.
